1. TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. To enter the Calling All Superheroes Sweepstakes (the “Sweepstakes”), an Eligible Adult (as defined below), who is either a parent/legal guardian of a student that is currently enrolled in elementary school (grades K–5), must complete the online registration form as instructed at www.scholastic.com/superherosweeps, between 12:01 a.m. Eastern Time (“ET”) on September 16, 2021, and 11:59 p.m. ET on October 28, 2021 (the “Entry Period”). Entries will only be accepted via the online entry portal and must be submitted during the Entry Period.
2. ELIGIBILITY: The Sweepstakes is open only to parents/legal guardians of a student that is currently enrolled in elementary school (grades K–5), whether in a public school, an accredited private school, or a home school in the 50 United States (or District of Columbia) which is in compliance with the laws and regulations of its state/district and who is over 18 (19 in AL or NE) at the time of submission and a resident of the United States (an “Eligible Adult”). Employees of Scholastic Inc. (“Scholastic” or “Sponsor”), Disney Destinations, LLC (“Prize Provider”) and their affiliates, and members of their immediate families (parents, children, siblings, spouse) or family members living in the same household (whether related or not), their parents, subsidiaries, affiliates, and their advertising, promotion, and production agencies, manufacturers or distributors of Sweepstakes materials are not eligible to enter. Void where prohibited or restricted by law. Any person who attempts to defraud or tamper with the Sweepstakes will be ineligible for prizes. Only one submission by each Eligible Adult and such Eligible Adult’s household will be accepted.
3. ENTRY: By submitting to the Sweepstakes, each Eligible Adult agrees Scholastic and its designees shall have a royalty-free, perpetual, fully paid up license to the entry (including all rights embodied therein) and may exploit, edit, publish, use, adapt, modify, create derivative works from or dispose of any entry and elements embodied therein, including names, addresses and biographical information, online, in print, film, television, or in any other media now or hereafter known for advertising, promotional, or other purposes throughout the world, in perpetuity, without compensation or notification to or permission of the Eligible Adult except as prohibited by law. The Eligible Adult’s personally identifiable information, as defined by applicable law, submitted in connection with his or her entry shall be subject to Scholastic’s privacy policy found at: scholastic.com/privacy.htm.
4. PRIZE: One (1) entry (the “Winning Entry”) will be selected in a random drawing from among all eligible entries received. The Eligible Adult that submitted the winning entry (the “Winner”) will receive one (1) vacation package (the “Vacation Package”) for the Winner and up to three (3) guests (each a “Guest”; collectively “Guests” and together with the Winner, the “Group”) for two (2) nights and three (3) days at the Disneyland® Resort in Anaheim, California (the “Resort”). The Vacation Package will consist of the following:
The approximate retail value (“ARV”) of the Vacation Package is Three Thousand Five Hundred Sixty-Eight Dollars ($3,568.00). The actual value of the vacation package may vary depending on point of departure and fluctuations of hotel rates and airfares. Any difference between the approximate retail value and the actual cost of the Vacation Package will not be awarded.
Sponsor will notify the potential winner to confirm acceptance of the prize. The potential winner and his/her Guests will be required to complete and return an affidavit of eligibility and liability/publicity and a COVID-19 release and waiver (collectively, “Affidavit/Release”) within ten (10) business days from the time of initial notification. If the potential winner fails to sign and return the Affidavit/Release within ten (10) business days, he/she may be disqualified and, at Sponsor’s discretion, a runner-up will be notified. If any Guests fail to sign and return the Affidavit/Release within ten (10) business days, the Guest may, in Sponsor’s sole discretion, be prohibited from traveling with the Winner. If the potential winner does not respond to the initial notification within the above time required by Sponsor, or if the winner notification is returned as unclaimed or undeliverable, such potential winner may be deemed to forfeit his or her prize and, at Sponsor’s discretion, a runner-up may be notified. If the potential winner is found to be ineligible or if he or she has not complied with these Official Rules or declines the prize for any reason, such potential winner will be disqualified and, at Sponsor’s discretion, the prize may be awarded to a runner-up. The potential winner will be notified on or around November 1, 2021 by the email address that they provided with their entry, and must return the signed Affidavit/Release to Scholastic within ten (10) business days from the time of initial notification, but no later than November 15, 2021 at 11:59 PM ET. The prize is non-transferable, non-assignable, and no alternative will be offered. Taxes on prize, if any, are the sole responsibility of the Winner.
Travel and lodging for the Vacation Package awarded by Sponsor must be completed prior to November 1, 2022 (the “Prize Redemption Date”), subject to applicable State of California guidelines. If by the Prize Redemption Date, California guidelines continue to require that only California residents visit California theme parks, and the potential winner does not reside in California, the Prize Redemption Date will be extended to one (1) year after the date that California guidelines begin to allow out-of-state visitors to California theme parks. The Group must travel together on the same itinerary, and air transportation must be round-trip from/to the same Departure Airport/Arrival Airport, as chosen by Prize Provider. Vacation Package fulfillment and travel are subject to certain restrictions, air travel/flight availability, and certain hotel/room availability at the Resort. The Vacation Package must be booked through a travel agent as designated by Prize Provider at least forty-five (45) days prior to arrival. Block-out dates apply. No extensions will be granted. Certain travel and lodging restrictions apply including airline carrier’s regulations and conditions. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. Scholastic and Prize Provider are not liable for any expenses incurred as a consequence of flight cancellation/delay. All elements of the Vacation Package (including, without limitation, the theme park tickets) must be used by the Group on the same dates during the redemption of the Vacation Package. Any portion of the Vacation Package not accepted or used by Winner will be forfeited. Vacation Package and its components (including, without limitation, theme park tickets) may not be used in conjunction with any other promotion or offer, separated, sold, exchanged or redeemed for cash, traded, transferred, substituted, assigned, upgraded or rescheduled to dates other than as set forth above, except in Prize Provider’s sole and absolute discretion. Theme park attractions and entertainment may be seasonal and subject to change without notice. Any damaged, lost or stolen theme park tickets or travel vouchers will not be replaced. The Vacation Package will not include the following: transportation from/to Winner’s residence to/from Departure Airport; transportation to/from the Resort if Winner lives within 250 miles of the Resort, airport departure fees, baggage fees; insurance (health, travel, medical); parking fees (unless stated otherwise); room service, laundry service, spa treatments; food or beverages; merchandise, souvenirs; incidental expenses; local or long distance telephone calls; tips, gratuities, service charges; or any taxes; or any other charges not explicitly included herein. A Guest under the age of majority pursuant to his/her applicable state of residence must be accompanied by his/her parent/legal guardian who must be at least the age of majority pursuant to his/her applicable state of residence and both will be deemed Guests of the Winner (unless the Winner is the Guest’s parent or legal guardian). Once selected by Winner, Guests cannot be changed without the express consent of Prize Provider, which may be withheld for any reason. The Winner and his/her Guests are responsible for having valid travel documents including government-issued photo identification and/or passports, as applicable. The Winner will not receive compensation for any element(s) of the Vacation Package (including, without limitation, theme park tickets) that any participant(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited. If the Winner chooses to bring less than the allotted number of Guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute prize or compensation provided to the Winner. The Winner may not charge any Guest for participating in the prize. Prizes are awarded "as is" with no warranty or guarantee, expressed or implied, being provided by Sponsor or Prize Provider. Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of the Group, related to any use or misuse of the prize or any prize-related activity or travel. Federal, state and local taxes relating to the prize are the responsibility of the Winner and Sponsor will issue all tax forms including a 1099 form to the Winner. Sponsor is the sponsor of the Sweepstakes. All disputes arising out of or relating to any prize provided by Prize Provider shall be resolved by applying the laws of California, without regard to conflict of law rules, and shall be solely and exclusively brought in state or federal courts within Orange County, California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail and govern.
