Graphix Publication Contest
NO PURCHASE NECESSARY TO ENTER OR WIN.
ELIGIBILITY: GRAPHIX PUBLICATION CONTEST (“Contest”) is open to legal residents of the fifty (50) United States and the District of Columbia, 18 years of age or older at the time of submission. Void where prohibited. Employees, officers and directors and their immediate family members (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, of Scholastic Inc. (“Sponsor”), its parent, affiliates, or subsidiaries are not eligible to enter or win. By participating, entrants (and, if eligible minors, their parents or legal guardians) agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Contest. Contest is subject to all applicable federal, state and local laws.
CONTEST PERIOD: Contest begins at 12:01am Eastern Time (“ET”) on July 21, 2016 and ends at 11:59pm ET on April 1, 2017 (“Contest Period”).
TO ENTER: During the Contest Period, to enter, visit scholastic.com/graphixcontest and follow the directions to complete and submit the official submission form, including a PDF portfolio with 12 pages of finished art and all other materials and information required under the submission form. All entries must be received by 11:59pm. ET on April 1, 2017. Limit one (1) entry per person/email address. Entries received in excess of the stated limitations will be void. Any attempt to use multiple names or email accounts or other tactics to enter more than the stated limits may result in the disqualification by Sponsor from the Contest and all associated entries will be void. Entries generated by mechanical, script, macro or other automated means or by any means which subvert the entry process are void. All entries become the property of Sponsor and will not be acknowledged or returned.
Entry must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.
By submitting an entry, entrant (and, if an eligible minor, his/her parent or legal guardian) represents and warrants that the entry conforms to these Official Rules and understands that Sponsor, in its sole discretion, may disqualify the entry for any reason, including if it determines, in its sole discretion, that the entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion.
USE OF ENTRIES: By submitting an entry, entrant hereby grants to Sponsor a nonexclusive license to reproduce, distribute, display, and/or transmit the entry in connection with this Contest and the advertising and promotion thereof, in any manner or media now known or hereafter devised throughout the world in perpetuity for advertising, promotional and other purposes, without further compensation, notification or permission. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of entries by third parties. Sponsor has no obligation to make use of the rights granted herein.
JUDGING: All eligible entries received by Sponsor will be judged by a jury of judges based on the following equally weighted criteria: 12 page excerpt of final art and text (sequential within the comics format) (“Judging Criteria”), to determine up to five (5) top entries. Winners will be determined by June 1, 2017, and announced on or about Thursday July 20, 2017.
Sponsor reserves the right to select fewer than five (5) Grand Prize winners /or none at all if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Sponsor will not reveal the judging scores or votes for any entry.
WINNER NOTIFICATION: Potential winners will be notified by e-mail and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, or a potential winner is not in compliance with these rules, the prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected. If a potential winner is an eligible minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein.
PRIZES: GRAND PRIZE: Up to five (5) winners will receive an offer to publish their work with Scholastic and a $15,000 advance, with $5,000 paid at the time of the contest announcement, $5,000 payable upon the Sponsor’s acceptance of the final manuscript, and $5,000 payable upon publication. Total Approximate Retail Value (“ARV”): $15,000. Awarding of prize is subject to winner signing a publication agreement with Sponsor’s standard terms and conditions and failure to sign the agreement will result in forfeiture of the prize.
PUBLICITY GRANT: Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, in any manner and with any materials, worldwide in perpetuity, without notice or review or approval.
RELEASE: Entrants, by participating, agree that Sponsor and its parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize (including any travel or activity related thereto) or participation in this Contest.
GENERAL CONDITIONS: Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries, votes or emails; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of entries, the tabulation of votes, the announcement of the prizes or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries or votes (as applicable) received prior to action taken using the winner determination procedure outlined above or as otherwise deemed fair and appropriate by Sponsor. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
PERSONAL INFORMATION: The personal information collected will be used in accordance with Sponsor’s privacy policy which can be found at http://www.scholastic.com/privacy.htm.
